Receive Justice After Falling off a Motorcycle Due to a Speeding Car

Posted on

If you were leisurely cruising through town on your motorcycle and were cut off by a speeding car, resulting in you falling off your bike and injuring yourself, the following tips can be used to help you receive the justice that you deserve.

Photograph the Crime Scene

Call the police or have a passerby make the call if you are too injured to do so or do not have a cell phone on hand. While waiting, take pictures of the crime scene with your phone or another person's. Make sure that you get plenty of shots, including the angle of your bike, your helmet, the other party's vehicle, and marks on the roadway. A police officer may also take pictures of the accident scene, but it is still a good idea to have copies of your own so that you can share them with an attorney at a future date.

Give a clear description of what happened to the officer who responds to the scene. If a police office offers to call an ambulance, accept their assistance so that you can be taken to a local hospital in order to have your injuries assessed.

Acquire Footage and Witness Statements

Pay close attention to your surroundings and the location of surveillance cameras. Take note of the businesses that use security cameras so that you can inquire about obtaining footage of what occurred prior to and during the traffic incident. If there are people standing in the vicinity or drivers who have pulled over in order to see what is going on, ask them if they would each mind providing you with a written statement. Witnesses can provide key information that will prove that you were not at fault, greatly increasing the chances of receiving a fair settlement.

Hire an Attorney and Sign a Medical Release

As soon as you feel up to it, contact several motorcycle accident attorneys and hire the one who you feel can handle your case the best. Provide your attorney with all of the information that you previously collected. Refrain from speaking about your case to anyone other than the legal professional who is representing you.

Sign a medical release so that your lawyer can use the information in it to strengthen your case. When you appear for your scheduled court hearing, all of the evidence that was acquired will help you achieve your goal of winning your case and receiving a monetary award to assist with paying your medical bills and repairing your motorcycle.
